http://mehdirahbar.blogfa.com/ مطالعات fa blogfa.com Fri, 02 Oct 2009 00:43:18 GMT http://mehdirahbar.blogfa.com/post-36.aspx <P dir=rtl align=justify><FONT size=3></FONT> <FONT size=3>قوه قضا به عنوان یکی از پایه های حاکمیت از چنان نقش بی بدیلی برخوردار است که، ضعف ویا حتی کوچکترین خطای سهوی تعادل درونی یک نظام را برهم خواهد زد.برای روشن تر شدن نقش این نهاد همین بس، اگر این نهاد که وظیفه سامان بخشی  ونظارت برعملکردهای سایر نهادهای اجتماعی را بر عهده دارد کارکردهای اصلی خود را فراموش کند به طور مستقیم دونهاد سیاسی دیگر (مقننه ومجریه) که عملا وظیفه برنامه ریزی های اجتماعی وسیاسی را به دنبال خود می کشد و همچنین زیرمجموعه های گستره وعریض وطویل را نیز به طور کامل متاثر از خود می سازد. پر واضح است چنانچه روابط  متقابل، مطابق با قانون  وعرف های اجتماعی به خوبی توسط این نهاد تنظیم واجرا نگردد در نهایت جامعه با بحرانهای مختلف روبرو خواهد شد. دیگر جای هیچ شک وتردیدی نیست که، در حوزه روابط متقابل میان حوزه عمومی جامعه و نهاد حاکمیت نیز قوه قضا نقش پر اهمیتی را به عنوان افزایش و یاکاهش اعتماد میان شهروندان و حاکمیت به دوش می کشد. با این تفاسیر کلی می‌توان نتیجه گرفت این نهاد اجتماعی تنها در صورتی موفقیت حاصل خواهد کرد که در رای ونظر واعمال قدرت در جهت منافع ملی با استقلال کامل وبدون هیچ وابستگی به گروهها ودسته بندی های درون حکومتی ونظامی،امنیتی عمل کند. یکسان انگاری تمام اشخاص با هرمنصب ومقام در برابر قانون به عنوان یکی از فاکتورهای اساسی  باید نه تنها در متن کتابهای قانون  بلکه، در عمل  نیز به خوبی مشاهده شود. </FONT></P> <P dir=rtl align=justify><FONT size=3>شاید با این معیار بندی یا تعریف یک( سنخ آرمانی) نسبت به ساختار سالم یک نهاد (قوه قضائیه)بتوان به ارزیابی دقیق از شرایط حاکم بر آن مجموعه پرداخت. حال باید از خود پرسید که چند درصد از معیارهای حقیقی مانند (استقلال وتفکیک یافتگی وبرخورد های مبتنی بر قانون) بر روی ساختار فعلی قوه قضائیه می نشیند. و در نهایت مشخص شودتا چه اندازه انحراف از تعریف های اولیه داریم. با نگاهی به حوادث اخیر در ایران(به ويژه زندان کهریزک) این ضعف عیان تر می شود که، ساختار قضایی در مجموعه ای از لایه های قدرت البته "پنهان" دست پا می‌زند. این لایه های پنهانی  قدرت  چنان در هم تنیده و ابهام آلود هستند که شناخت و ارزیابی حدود وثغور واقعی قدرت  قضایی  یک کشور گاهی برای متخصصان و تحلیل گران سیاسی  نیز سخت می شود. به نظر می رسد  کادر جدید مدیریتی یک بار برای همیشه باید دست به یک انتخاب بزند؛ یا باید با  یک تصمیم  شجاعانه  خود را از سیطره قدرت های پنهان و مداخله گر بیرون آورند ویا اینکه به روال قبل ادامه دهند و بحرانهای بیشتری را برای جامعه به ارمغان آورند.</FONT></P> Fri, 02 Oct 2009 00:43:18 GMT http://commenting.blogfa.com/?blogid=mehdirahbar&postid=36 mehdirahbar http://mehdirahbar.blogfa.com/post-36.aspx http://mehdirahbar.blogfa.com/post-35.aspx <P align=justify><FONT size=3>چندی پیش قبل از آنکه زنگ بازگشایی دانشگاهها به صدا درآید، نقدهای مطرح شده پیرامون علوم انسانی و جایگاه نظریه پردازی غربی در ایران به شدت توجه هر دانش آموخته علوم انسانی را به خود مشغول کرد. از مجموع اظهار نظرها اینگونه برمی‌آمد که اراده ای جدی وجود دارد که اعلام می دارد چارچوب علوم انسانی در ایران با مبانی دینی و ارزشهای مذهبی جامعه مغایرت دارد. اهمیت طرح امروز این موضوع چندین پرسش مهم را پیش روی ما قرار می‌‌‌‌‌‏‏‏ دهد. سعی نگارنده بر این است که از میان پرسشهای مطرح شده به یک پرسش مهم و براساس تجربیات شخصی و همچنین تعاملی که در مدت تحصیل با استادان وشارحین نظریات غربی در دانشگاه داشتم  پاسخی بیابیم. </FONT></P> Sun, 27 Sep 2009 21:18:18 GMT http://commenting.blogfa.com/?blogid=mehdirahbar&postid=35 mehdirahbar http://mehdirahbar.blogfa.com/post-35.aspx http://mehdirahbar.blogfa.com/post-34.aspx <span class="Apple-style-span" style="font-family: Lotus;
